Employment/HR Questions....ADVICE NEEDED?

Faviola Dewire: ouch -I would have gotten their offer in writing first. It does sound like they are using you and on top of that, know that you were looking - and finding - another job "behind their backs" so you will probably be on their radar screen.I am always suspicious when you are so unhappy with a job that you want to leave it. The environment is already not good and even a promotion or transfer might not fix it. They probably know that and don't care.I hope the other company reconsiders, but unfortunately they don't know you well enough probably and might see you as a flake.Sorry, wish you the best. I have a crappy job too but I have been offered a position in one of our divisions once a new line of products comes out. High dollar stuff - then they can 'afford' me. Veta Slicker: There's not much you can do at this point, you just have to look for another job and when you find a good one then take it at once without looking back, if you really want to get back at the company, tell them on the last day that you're leaving, don't even give them any advance notice.

Conrad Puleio: Thinking for oneself and not basing the decision on intangible promise is something I learn that the hard way too. I guess until the promotion and transfer actually happen, always be skeptical and don't just take your boss's word for it (no matter how nice he was). Can't really blame the other company that refuse to offer u the job again since they might fee! l that you're not as enthusiastic to work with them and might ! jump ship the moment a better offer comes along. Unless you're able to have a heart to heart talk with them, stating what happened and how you realized your mistake in a way that would contribute significantly to your next job. (It all depends on how you spin it).Meanwhile, try to look for another job. If you get it, leave your current company. I think it will be wise to still give them advance notice. The company being a bastard doesn't mean that you shouldn't hold up your end of work ethics. But then again, that's me. Arnoldo Budzynski: From a legal perspective, it looks like they breached an agreement to promote and transfer you in consideration for your not taking another job. If the other company doesn't re-extend its offer, then you're out the difference in compensation between your current job and what was offered. You may be able! to recover other "damages" as well. Suing your current employer may not be a good alternative given how much it costs and how it would affect your relationships in the company; but you may be able to lodge a complaint with a labor department or commission in your state or local government designed to help workers with issues of compensation, so I would check out what state or local government resources are available. There are some questions you need to ask. Do you still want to work for your current employer? If not, then your strategy may be to sue or seek help through some government enforcement mechanism. If you do, then you use your knowledge of your claim as a basis for them stepping up to the plate and delivering what they promised. If they refuse to do so, then why would you want to work with them anyway?So take time to jot down the different things that they may do and plan out your response ahead of time so the emotions of any negative reaction or inaction don't! lead you to say the wrong things or make some impulsive decision you w! ill regret.Finally, it's a little confusing. If you are saying they made you the offer for a promotion and transfer, but later found someone else for that position, then your best recourse may be one of the two legal alternatives I mentioned. They burned their bridges and they now can't deliver on their promise. There are some employment attorneys who may be willing to take on your case on a contingency so you don't have to pay hourly fees but they ask for a percentage of whatever you recover either in settlement or in court. There is a bar association in your state and even your county that probably has a resource line for people to call who need legal help. Check it out....Show more

Nicolasa Henke: If you didn't get anything in writing, you have no recourse. If the second company will not hire you, keep looking until you find something else. TAKE IT! Even if your current company would be willing to put an offer in writing, they obviously don't have the integrity ! they should have.
